Chelsea's POTUS questions

Republicans have lately taken drastic steps against what they say is a plague of voter fraud. Indiana now requires every would-be voter to present a government-issued photo ID before casting a ballot. If the Supreme Court upholds that requirement, other states may pass or strengthen similar laws. What is your view of the prevalence of such voter fraud, and what should be done about it?

Will there be a pre-existing conditions clause in the new Health care reform bill?

You have insisted that health care reform “bend the cost curve down.” CBO Director Elmendorf says the bills being debated would instead raise the health care cost curve and would increase long-term budget deficits. Will you continue to insist that health care reform not increase the deficit?

Amendment 2 (Right to a militia and right to bear arms)

Right; The state's right to maintain a militia for it's own protection.
arguments; States could develop large militias that are dangerous to the well being of the union.
Source; English Bill Of Rights 1689
Court case; United States V. Cruikshank (White militia men murdered over 100 black men in the colfax massacre during reconstruction. Supreme court left punishment up to states.)
Contemporary/why?; This is not a large issue today.


Right; The Right To Bear Arms
Arguments; Anyone owning guns could lead to chaos.
Source; Assize of arms
Court case;District of Columbia v. Heller rejected a ban on the private posession of handguns.
Contemporary; This is a highly debated issue. Some people thing there should be no government regulation on guns whatsoever.

2) united states v. bajakajian fined $357,144 for trying to leave with that same amount of money out of the country without telling the U.S. government. (You must report it if leaving the country with more than $10,000)
3) solemn v. helm (1983)(sentenced to life in prison with no parole for a bad check)

Contemporary/why?
1)Couldn't find one

3) the united states is one of the few secular democracies that still execute prisoners. cruel prison punishment.

Amendment 5 (Double Jeopardy and self-incrimination {Bonnies work fleshed out by me})

Right: Shall not be tried for the same offense twice.

Arguement against: Allows guilty men to get away.
CourtCase/why?: The case of Jack Mcall. Killed a man on indian territory, tried both there(where he was found innocent) and in american territory(where he was found guilty and killed). Double jeopardy? No. Because Deadwood, the indian territory, was not technically in america even if the impromptu trial was held by Americans. (Bad example, I know.

Harry Aleman vs. Judges of the Criminal Division. Double jeopardy does not prevent a new trial if the first trial was somehow tainted. (In this case, bribery)

contemporary: It still leaves room for criminals to get away. (I know you did it, O.J.)

Right: Self-incrimination.

Arguement against: Criminal could be the only witness

Court case/ why?;Miranda V. Arizona (Miranda confessed without an attorney also without the knowledge that he could HAVE an attorney present)
Contemporary; Miranda rights are now a debatable process.

Right; Can't be prosecuted of a capital or otherwise infamous crime without indictment of a grand jury.

Argument: Defendant shouldn't have to stand trial without being represented by an official who may be able to prove him/her innocent
Court Case: Johnson v. Zerbst (Anyone who cannot afford an attorney will be appointed one by the court without question)
Contemporary: Defendants have attorneys unless they opt to represent themselves in court

Right: Public Trial

Argument: Accused should be able to have a public trial
Court Case: Sheppard v. Maxwell (right to public trial is not absolute)
Contemporary: Public trial may be switched to closed trial if there is the threat of prejudicing the jury or harming participants

Argument: The word of witnesses outside of court used to be accepted as legal testimony.
Court Case: Crawford v. Washington (hearsay was used in trial against the accused)
Contemporary: All testimony must be heard inside the courtroom in front of the defendant to be accepted by the court

Argument: Defendants were once held for unreasonable amounts of time before standing trial.

Found absolutely NOTHING.

It grew out of a complain against the British. Soldiers needed a place to stay during the war.

Argument Against:
Soldiers needed a place to stay that provided food during the war.

Court Case:
Engblom vs. Carey (1982)
Rights were violated during a statewide strike of correction officers that were evicted from their facility residences without notice and their residences were used by national guard without the officer's consent.

Contemporary:
No, it's no longer in use. Government can build it's own residence. It's self sufficient.

Amendment 4

Amendment 4

Right 1: Police cannot search a person or their belongings without probable cause.

Source or Originator: From complaints against the King-The King would send officers to search people's houses for anything relating to John Wilke's pamphlets attacking the government and the King.

Argument against: The King obviously did not want to lose the right of going to people's houses and searching it without a probable cause. By searching people's houses when he felt like it, he could keep them from rebelling against him.

Court case/Why?: Warden v Hayden (1967). Police went into a house after armed robbery was reported. The resident gave permission to search the house and they found Warden and the gun. He argued that the police did not have probable cause to search the house, and therefore the evidence they found could not be used against him. Decision: The police had probable cause-they recieved a call reporting armed robbery.

Comtemporary/Why: Terry v Ohio (1968) A police searched three men that looked suspicious and found two of them were carrying a gun. Terry was convicted to three years in jail. He aurgued the search had been with no problable cause. The Supreme court convicted Terry to the three years in jail, saying the officer was securing his safety and the public's
--'Probable cause' is debatable.


Right 2: A warrant is needed to search someone's property

Source or originator: Entick v Carrington (1765). Three messengers sent by the King entered Entick's property and searched it wihout Entick's consent and against his will. It was decided that a state officer could only enter a peron's home with permission or 'in a manner prescribed by law'.

Argument against: again, the King opposed it.


Court case/ Why?: Georgia v Randolph (2006)-Scott Randolph was arrested after the police found cocaine in his home. The police did not have a warrant, Randolph's wife gave permission for the search, but Randoplh did not. Decision: Randolph was not convicted, the search was unconstitutional because the police did not have a warrant and they searched without Randolph's consent.


Contemporary/ Why?: When police have a probable cause and they don't have time to go to a judge for a warrant police are allowed to search property.

Argument Against;
I couldn't really find a very good argument against this. Help would be greatly appreciated.
Court case/ why?;
Engel V. Vitale (1962)
State of NY endorsed religion by creating a prayer to be said at the begining of every school day. Supreme court ruled this as illegal.
(FYI, this is the prayer Almighty God, we acknowledge our dependence upon Thee, and we beg Thy blessings upon us, our parents, our teachers and our country. Amen.)
Contemporary/ why?;
The pledge is still widely debated whether it infringes on American's freedom of religion or not.

Again, kind of difficult, who wouldn't want freedom of speech?

This case decided that freedom of speech does not cover porfanity.

Freedom of speech is used to shield slanderers from formal punishment. Also, this is being infringed upon by the Patriot Act.

Argument Against;
The state should have the right to be able to pull articles before they are published if they hurt the nation.
Court case/ why?;
Near V. Minnesota (1931)
This case decided that the state has no right to restrain the press prior to their release even if it threatens the well being of the state.
(Another FYI; This case came about because there was a man in the newspaper that said some local government officials were involved in gangs, drugs, etc. The supreme court ruled that it was a violation of the first amendment to have prior restraint on the press.)
Contemporary/ why?;
Many people are victimized by biased news reports that throw out whatever benefits their party without being fact checked. Example; the 2000 election. Fox news said Bush won when it was still up for debate.
